Planning, Zoning & Land Records Committee

Chairman Wiese called the meeting to order at 9:00 A.M. and staff certified the meeting had been properly posted.

Motion by Cassity, seconded by Sprecher to adopt the agenda as presented.

Motion by Sprecher, seconded by Lehman to approve the minutes of the December 8, 2003 Committee meeting with grammatical corrections as noted by Cassity. Motion carried.

Communications - None.

Business items -

Mr. Lehman asked for a clarification on the point control project being carried out by Team Engineering. Mr. Gurney explained that they were 44% into the contract with only 12% being completed. A letter was being prepared by Mr. Filus and the Corporation Counsel requesting the status of the project.

The Committee then reviewed the vouchers for the Register of Deeds' department. Motion by Cassity, seconded by Lehman to approve the vouchers in the amount of $161.49.

Mr. Gurney, Planning and Zoning Director, then gave his monthly report. There will be a public meeting in Spring Green on January 26, 2004 to review the airport ordinance. Neighboring communities as well as property owners within a 3 mile area will be notified. The department was in the process of completing a Wisconsin Fund project request for funding. So far there are approximately 25+ applications. Mineral extraction agreements were being reviewed. The sign ordinance that passed in September required the department to notify land owners and companies with signs along Highway 12 of the regulations. Mr. Gurney explained the setback requirements and which signs were "grandfathered". Mr. Lehman asked how many signs were involved. Mr. Gurney stated that there were approximately 112 signs, but some of them were in the annexed portions of the Village of West Baraboo. There were approximately 80 signs outside of the villages' jurisdiction. Mr. Cassity asked if a sign was within a right of way did it have to be brought up to code or just removed from the right of way.

The Committee then briefly discussed the Sauk City bypass project and USH 12 plan. The billing reviewed was for the completion of the Sauk City Bypass Alternative study. Two meetings were scheduled with Vandewalle , the DNR and DOT. Motion by Cassity, seconded by Sprecher to approve payment of the invoice in the amount of $503.25.

The Planning and Zoning invoice lists were then reviewed. Motion by Sprecher, seconded by Cassity to approve the vouchers as presented.

Chairman Wiese called the public hearing to order at 9:40 A.M.

The hearing procedure was given and the Committee introduced themselves.

The only item for review today was a petition to rezone certain lands in the Town of Winfield, Sauk County, Wisconsin, from an Agriculture zoning district to an Single-Family Residential zoning district by Mark Pelton, S1930 Glen Valley Drive, Reedsburg, WI 53959. The purpose of the request is to expand and existing residential subdivision by approximately 12 to 15 lots. The parcel of land affected by the rezone is located in Section 25, T13N, R4E in the Town of Winfield.

Mr. Brian Simmert, Planning and Zoning Staff, gave a brief history of the Pelton subdivision and this rezone request as well as the staff recommendation of approval.

Access off of Drover's Pass was discussed. Mr. Simmert reminded the committee that this was for the rezone only and not approval of a subdivision addition.

Mr. Mark Pelton, owner, appeared and explained this was just an addition to the existing subdivision. Mr. Wiese asked about the steep slopes. Mr. Pelton explained that Drovers Pass takes are of most of the problem slope areas. Mr. Cassity verified that this is not within the ET area for the City of Reedsburg. Drovers Pass is a town road and is maintained by the town. Getting another access off of Highway H was discussed if Highway H ever became a state road. Mr. Pelton explained how that would be handled and that a second access would not be necessary.

"Right to Farm" clauses and deed restrictions regarding continued agricultural uses in the area were discussed.

Mr. Phil Cracker, Town of Winfield Chair, then appeared. He stated that the Town operated on common sense and they were already ahead of the county on "clustering". The Town Board was in favor of it and felt it was a very good project. He stated that people already living in the subdivision were satisfied.

Seeing no one else wished to speak, the public portion of the hearing was closed at 10:00 A.M.

Motion by Cassity, seconded by Sprecher to approve the rezone request.
Motion carried. 4-0.

The next meeting is scheduled for Tuesday, January 13, 2004.
