Personnel Committee - Minutes


DATE: Thursday, November 4, 2004 - Room 213

ATTENDANCE: Members present: T. Meister, C. Montgomery, P. Tollaksen, S. Alexander, T. Bychinski

Others Present: M. Koehler, J. Briggs, K. Pope, K. Olstadt, L. Peper, P. Schrank, M. Burggraf

CALL TO ORDER: The meeting was called to order by T. Meister at 8:30 a.m. and was certified to be in compliance with the Open Meetings Law.

AGENDA: Motion by T. Bychinski, second by S. Alexander, to adopt the amended agenda.
Motion carried.

MINUTES: Motion by C. Montgomery, second by T. Bychinksi to approve the October, 2004 minutes of the Personnel Committee with noted correction. Motion carried.

COMMUNICATIONS: M. Koehler reminded the Committee of the letter submitted by R. Rosenbaum regarding the payout of sick leave at retirement at the one hundred percent conversion. It was the consensus of the Personnel Committee Mr. Rosenbaum's original notice of retirement was submitted within the required time frame and had not been negated, therefore he was eligible for the full sick leave conversion. No action was required.

AFSCME LOCAL 3148 GRIEVANCE - SENIORITY:

The Personnel Committee heard the grievance of L. Peper regarding recognition of seniority in the posting process. In the absence of the Business Representative, W. Moberly, the grievance was presented by K. Olstadt, Local 3148 Chief Union Steward. L. Peper has eighteen years with the Health Care Center, thus having more seniority then the individual who was awarded the position.

K. Pope presented for management and cited the contract language which states, "When qualifications, recent work record and abilities are relatively equal, selection shall be made on the basis of seniority." Pope explained more than seniority is taken into consideration.

Motion by P. Tollaksen, second by T. Bychinski to enter into closed session pursuant to Wis. Stat. 19.85(1)(c) for the purpose of considering employment, promotion, and compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility over. With M. Koehler, K. Pope, J. Briggs, P. Schrank, and M. Burggraf to remain. A roll call vote was taken: Meister - aye, Montgomery - aye, Tollaksen - aye, Alexander - aye, Bychinski - aye. Motion carried.

Motion by C. Montgomery, second by P. Tollaksen to reconvene in open session. Motion carried.

Motion by C. Montgomery, second by P. Tollaksen to deny the grievance. Motion carried.

 

DEPARTMENTAL UPDATE :

M. Koehler notified the Committee of the settlement of the United Professionals bargaining agreement through mediation on October 25, 2004. A resolution ratifying the agreement will be presented in December.

M. Koehler presented the Committee with departmental updates on recruitments, worker's compensaiont, unemployment and leaves.

K. Pope advised the Committee of Personnel activities for the past month at the Health Care Center. The report included updates on recruitments, worker's compensation, unemployment and leaves. Pope informed the Committee the annual review of health insurance category placement for employees has been completed.

Motion by S. Alexander, second by T. Meister to approve payment of the monthly vouchers in the amount of $2,132.75. Motion carried.

Motion by C. Montgomery, second by T. Meister to adjourn with the next regular meeting to be held Thursday, December 10, 2004, at 8:30 a.m.
Motion carried.
