ORDER OF BUSINESS

  1. Call to order, certification of open meetings notice.
  2. Approval of agenda.
  3. Approval of minutes of previous meeting.
  4. Communications.
  5. Board of Adjustment public hearing beginning at 9:00 a.m.
    1. John Hillmer & Deb Hintz, (SP-29-04), a special exception permit per s. 7.10(2)(b)4 to authorize the construction of a pond within 300 feet of a road or property line.
    2. Donald & Karen Gardner, (SP-31-04), a special exception permit and a variance per s. 7.05(2)(k)5, to authorize the operation of an existing dog kennel within 1000 feet of a neighbors residence.
    3. John Oliver, Ethanol Productions Inc., Rod Aide, (agent), (SP-32-04), a special exception permit per s. 7.10(2)(b)7 to renew the a permit to continue the operation of an ethanol plant.
    4. Steven & Laura Mallon, (SP-33-04), a special exception per s. 7.05B2(b)3 to authorize the construction of a pond within 300 feet of a road or property line.
  6. Appeals from previous hearings.
    1. Daniel A. Sergi, (SP-23-04). The applicant is requesting a variance pursuant to s. 7.18(3)(b) to authorize the construction of a garage within the minimum road setback. The property is located in the Single Family District on real estate described as: S1272A W. Redstone Dr., lot 17 Oriole Addition to Lake Redstone, part of the NW ¼, NE ¼, section 23, T13N, R3E, Town of La Valle, tax parcel 024-2196
    2. Steven & Marsha Luther, (SP-18-04), a variance to allow a residence to be constructed in a floodway and a change in administrative decision to remove a Stop Work Order issued by Planning & Zoning.
    3. Lawrence Smith, (SP-16-04), two special exception permits per s. 7.05(2)(k)10 and 7.05(2)(k)20 to authorize the location of a private landfill and an Agricultural related business (sale of old farm machinery).
  7. Possible viewing of sites with the time and location to be announced at the hearing. Viewing will take place the date of the hearing prior to adjournment.
  8. Adjournment.
