Planning & Zoning Committee Meeting Minutes


DATE: November 8 , 2004

Committee Members Present: Lehman, Ashford, Gaalswyk, Sprecher, and Wiese.

Others Present: Lance Gurney, Mary White, Brent Bailey and Marvin Giebel.

Chairman Wiese called the meeting to order at 9:00 a.m. and staff certified the meeting had been properly posted.

Motion by Sprecher, seconded by Gaalswyk to adopt agenda as submitted.

Motion by Gaalswyk, seconded by Ashford to approve the minutes of the previous meeting.

Communications: Mr. Gurney distributed a letter from the Town of Merrimac in opposition to the tower sighting ordinance amendments.

Business Items: None

Mr. Brent Bailey, Register of Deeds, appeared and noted that office work load was relatively stable. He reported on progress or lack of regarding online records. Mr. Bailey met with the MIS Department regarding the on-going problems. The MIS Department had received a call that the consulting agency was going to look into the problems. Mr. Bailey stated there were several options that could be followed. Either the County could request some of the money back or could ask for the program itself. The firm would be given until the first of the year to correct the problems.

Mr. Bailey presented his vouchers for review. Motion by Ashford, seconded by Gaalswyk to approve the vouchers in the amount of $5, 012.99. Motion carried.

Mr. Lance Gurney, Planning and Zoning Director, then appeared and gave a brief monthly report. He stated that a workshop had been presented for planning commissions and town board members. Approximately 40 people attended. Office staff was also working with the Village of Lime Ridge and the Town of Merrimac on their draft plans. Work was also proceeding with other municipalities.

Mr. Lehman had questions regarding animal units in ordinances.

The Committee briefly discussed the meeting and hearing schedule for 2005 Planning, Zoning and Land Records Committee meetings. Motion by Ashford, seconded by Lehman to approve the schedule with no changes at this time. Motion carried.

The next subject for discussion was a development plan and preliminary plat review of a subdivision known as Delton Woods in the Town of Delton. Mr. Gurney stated that the covenants had been completed, bylaws were set and storm water management measures were completed. A public hearing was held in early September. Mr. Lehman asked if the "right to farm" was included in the covenants. Mr. Gurney stated that it was. Mr. Gurney stated that the outlots would be owned by a property owners group and if that group was disbanded the ownership would be deeded to all property owners. Motion by Gaalswyk, seconded by Ashford to approve the development plan and preliminary plat of Delton Woods subject to covenants, final review and approval of staff. Motion carried.

The rezoning application of Thomas Ritzenthaler for rezoning from Ag to Single Family Residential in the Town of Delton was reviewed. This subdivision is about 1/4 mile east of the airport. Mr. Gurney stated that the City of Baraboo had recently been changed to a Class 3 city which could extend their extraterritorial zoning rights out to 3 miles from the city limits. Mr. Gurney stated that it was his impression that the City would not approve any development within this area unless it was connected to city sewer and water. At this time the property is zoned agriculture and the Committee did not feel comfortable with rezoning to single family residential without knowing what the City was going to do. Mr. Marvin Giebel, Delton Town Board Chairman, stated that he wasn't aware of the fact that the City of Baraboo was going to extend their jurisdiction out 3 miles. Mr. Gurney said that it was his impression that the City had approved this extension of jurisdiction in September. Mr. Giebel said that the Town property and there was other residential property around it. Mr. Gurney was concerned that the Committee may approve the rezoning and the City may deny the request. Ms. Ashford stated that it made sense to postpone the Committee decision until the City has acted on it. Mr. Giebel wanted Committee agreement that they would approve the project if the City did. Mr. Sprecher said that conditional rezoning could not be done. Motion by Ashford, seconded by Gaalswyk to postpone a decision until after the City of Baraboo has made a decision subject to town review and approval. Motion carried.

Motion by Gaalswyk, seconded by Ashford to adjourn until November 23, 2004.
