Members Present: W. Wenzel, V. Hartje, L. Haugen, C. Montgomery, H. Sprecher, T. Kriegl, J. Earl, L. Haugen, R. White, S. Schlender, S. Hannah, and S. Clement.
Others Present: T. Liebman, G. Wiegand, B. Mielke, B. Muhlenbeck, R. Cassity, K. Olson, K. Zowin, J. Lally, J. Kozlowski, R. Valeh, G. Bebau, R. Valek, C. Kissack, C. Bodendein, and F. Piraino.
The meeting was called to order by Chairperson Wenzel at 5:30 P.M. and compliance with the Open Meeting Law was verified.
Motion by Hartje, seconded by Montgomery to authorize Chairperson
Wenzel to continue conducting the joint meeting.
Motion carried.
Chairperson Wenzel suggested reversing the order of items #3 & 4 on the
agenda; motion by Sprecher, seconded by Hartje to adopt the agenda,
in its original format. Motion carried.
Beverly Muhlenbeck, Public Health Director/Health Officer, introduced
Cindy Bodendein, Home Care Supervisor and the following citizen
members of the Public Health Board: Stacy Clement, Sandy Schlender,
and Dr. Stuart Hannah. Ms. Muhlenbeck also distributed copies of Mr. Kozlowski’s
animal permit application as well as other pertinent information.
Discussion on insurance and other permit requirements followed.
Attorney Liebman noted the situation at hand and reason for calling this meeting (the keeping of certain restricted animals) posed a potential ordinance violation and he was not comfortable discussing any specifics in open session. However, Chairperson Wenzel offered the following individuals a chance to speak and air their concerns: Georgian Beer, neighbor; Jeff Kozlowski, Big Dads Big Cats owner/operator; Virgil Hartje, County Board member; Rose Vallick, neighbor; Kirk Olson, former landlord of Jeff Kozlowski; Rose White, County Board member; Paul Endres, County Board member; Joe Lally, Public Health Department employee, and Robert Bell.
Motion by Haugen, seconded by Hartje to go into closed session
pursuant to Wisconsin State Statutes, Section 19.85(l)(f) “Conferring
with legal counsel for the governing body who is rendering oral or written
advice concerning strategy to be adopted by the body with respect to litigation
to which it is or is likely to become involved” and allow the following
individuals to remain: T. Liebman, B. Mielke, B. Muhlenbeck,
J. Lally, G. Wiegand, and any County Board Supervisors in attendance (K.
Zowin and R. Cassity). Supervisor Cassity requested the Village President
of the Village of Rock Springs be allowed to remain. The request was denied
upon recommendation of the Corporation Counsel. Roll call vote was taken
on the motion with a unanimous aye vote. The Committees went into closed
session at 6:20 P.M.
At 6:45 P.M. the Committees returned to open session. No motion
for enforcement action of an ordinance violation by the Corporation
Counsel was recommended. Motion was then made by Hartje, seconded
by Montgomery to approve granting Mr. Kozlowski a permit for
the keeping of certain restricted animals, as outlined in SCCO, Section 27.10,
providing a signed agreement is received from his insurance company which
indemnifies and holds Sauk County harmless. The Committees then directed
the Public Health Dirtector/Health Officer to work with the Corporation Counsel
on finalizing any other permit details.
Motion by Montgomery, seconded by Haugen to adjourn.
Motion carried
and the meeting adjourned at 6:50 P.M.
