Planning & Zoning Committee Meeting Minutes


DATE: May 24, 2005

Committee Members Present: Wiese, Gaalswyk, Sprecher, Lehman, and Ashford.

Others Present: Lance Gurney, Mary White, Larry Volz, Roman Statz, Steve Pate, and Brent Bailey, Mike Huth, and Harold Spink.

Chairman Wiese called the meeting to order at 9:05 a.m. and staff certified the meeting had been properly posted.

Motion by Sprecher, seconded by Ashford to approve the agenda as presented.
Motion carried 4-0.

Motion by Gaalswyk, seconded by Ashford to approve the minutes of the May 12, 2005 Committee meeting.
Motion carried 4-0.

Communications - Mr. Gurney stated he had some correspondence that would be handled under later discussion.

Discussion followed regarding posting of meeting notices and minutes on the web site. Mr. Gaalswyk felt this should be done as soon as possible and draft minutes should be posted as drafts. Mr. Gurney stated that the Corporation Counsel's opinion was that the minutes were not official until the Committee approved them. Agendas were posted as soon as they were prepared.

Business items - none.

Mr. Steve Pate, MIS, appeared and presented a license agreement for Sauk County digital geographic data sets. This agreement was to prevent the duplication or redistribution, without the consent of Sauk County, of information posted on the web. Motion by Gaalswyk, seconded by Ashford to approve the license agreement.
Motion carried 4-0.

Mr. Pate presented his voucher list for approval. Motion by Ashford, seconded by Gaalswyk to approve payment in the amount of $12,577.29.
Motion carried, 4-0.

Mr. Gurney stated that Mr. Pate and members of the Mapping staff did a very good job of bringing all the data sets together.

Mr. Brent Bailey, Register of Deeds, appeared next. Increased revenue to the County through condo sales by developers was briefly discussed.

Mr. Bailey will be getting user ID's to the Committee next week so they will be able to review deeds, certified surveys and mortgages on the web. He will need to review the fees charged with the Committee. He is hoping to keep the charges down so that the site is used by the public. At this time he is still checking the content of the site and he wants to look at the charging options available. The medium used for plats was briefly discussed and Mr. Gurney stated that he would like a digital copy to be required also.

Motion by Gaalswyk, seconded by Sprecher to approve the Register of Deeds' vouchers in the amount of $264.52.
Motion carried 5-0.

The Committee requested that the County Surveyor attend the next meeting to discuss remonumentation and problems in the Town of Washington. They also requested that a representative from Team Engineering be present.

Mr. Gurney, Planning and Zoning Director, appeared next with his monthly report. He stated that the State Joint Finance Committee met and recommended repealing the comprehensive planning law and taking money collected by the Register of Deeds and adding it to the general fund. Many municipalities needed that money to fund special projects. Mr. Gurney said that Mr. Brenson had been instrumental in obtaining this funding for Sauk County in the past.

Mr. Gurney said that it has taken four years to approve the East Lake Virginia Estates subdivision and during that time rules for storm water control had changed. The documents have been reconfigured and approved by the town and he recommended approval by the Committee. Motion by Ashford, seconded by Gaalswyk to approve the amendment to the Declaration of Covenants, Conditions, Restrictions and Easements for East Lake Virginia Estates, revised erosion control plan, and revised long term stormwater management maintenance agreement.
Motion carried, 5-0.

The next item for discussion was a proposed rezoning from an Agricultural District to a Commercial Zoning District by Harold Spink. Mr. Spink had already received approval from the Town of Fairfield and Committee regarding his property in the Town of Fairfield. This parcel for rezoning is located in the Town of Delton, adjoins the Town of Fairfield parcel and is west of the existing golf course. Mr. Larry Volz, Town of Delton, appeared in favor. The Town of Delton had already approved the request. Motion by Sprecher, seconded by Lehman to approve the rezoning.
Motion carried 5-0.

A rezoning by Gary Ringstad in the Town of Delton was next for review. Mr. Roman Statz stated the Town of Delton had approved the request with certain design elements. Discussion followed regarding screening and colors for the structures. Motion by Sprecher, seconded by Ashford to approve the rezoning from an Agriculture District to a Commercial Zoning District.
Motion carried 5-0.

The next item for discussion was a request by Jeff Tobin to waive a subdivision plat requirement. Mr. Gurney stated that the Committee had previously allowed waiving lot requirements in ET areas. Mr. Gurney explained what divisions had been made and what divisions were still considered. He stated that he was not in favor of this request. Motion by Ashford, seconded by Sprecher to deny the request to waive the subdivision plat requirement.
Motion carried 5-0.

The Committee then reviewed ordinance revisions regarding Bed and Breakfasts, assisted living/dependency living arrangements and lodging houses. Exclusive Agriculture does not allow for Bed and Breakfasts, lodging houses or assisted living arrangements. They are considered special exceptions in the Agriculture District. Many towns are looking for alternatives to provide other income that does not have the impact commercial uses would. Cottage industry and lodging houses were discussed. Mr. Gurney asked if the department should pursue enforcement issues with the Bed and Breakfasts. Motion by Gaalswyk, seconded by Sprecher to suspend enforcement action in the RC and Exclusive Agriculture Districts for Bed & Breakfasts, assisted living/dependency living arrangements and lodging houses and seek necessary amendments to allow those uses as special exceptions.
Motion carried 5-0.

The Committee then reviewed vouchers for the Planning and Zoning Department. Motion by Ashford, seconded by Lehman to approve the vouchers in the amount of $2,680.79.
Motion carried 5-0.

Motion by Ashford, seconded by Gaalswyk to adjourn to June 14, 2005.
