Chairman Weise called the meeting to order at 9:00 a.m. and compliance with the open meetings law was noted.
Motion by Sprecher, seconded by Ashford to adopt the
agenda.
Motion carried 4-0.
Motion by Sprecher, seconded by Ashford to approve the minutes from the
June 27, 2006 meeting.

There were no departmental updates for Register of Deeds, Surveyor, Mapping and Planning and Zoning Departments.
This first item for discussion and possible action was a request by Mark
Carlson, agent for Glen Struble and Janet Klipp-Struble regarding a reduced
public access requirement on a certified survey map. Mr. Gurney explained
the reason for the request. This was an existing easement which varied
from 20 to 40 feet and served only one house. Discussion followed. Motion
by Ashford, seconded by Sprecher to approve the easement request.
Motion carried 4-0.
There was general discussion on the Conditional Use Permits presented at today's meeting. Mr. Gurney gave brief background. The Committee reviewed the procedure to be followed.
Discussion and action on the application for a conditional use permit to create a 3.78 acre residential lot in Section 23, T10N, R4E, Town of Honey Creek, Sauk County by Dale and Debra Schwanke/Eileen Muchow in accordance with the PUD (clustering) provisions of Sections 7.05B(2)(c), 7.12 and 22.71 of the Sauk County Code of Ordinances.
Mr. Gurney gave the staff report and Findings of Fact. The Committee read
and answered each question in Section III: Conditional Use Permit Standards.
Section V: Conditions were reviewed and 5. was added to say that the approval
was contingent on approval from the Town of Honey Creek. The Town was meeting
tonight. Motion by Lehman, seconded by Gaalswyck to approve the Conditional
Use Permit and the Preservation Area Easement with the added condition
that approval be contingent on Town approval.
Motion carried, 5-0.
Mr. Hendee requested clarification. Motion by Ashford, seconded by Gaalswyck
to approve the Preservation Area Easement specifically.
Motion carried, 5-0. In the future this approval will be combined
with the Conditional Use Permit approval.
Discussion and action followed on the application for a conditional use permit to create a 3.58 acre residential lot in Section 6, T12N, R4E, Town of Reedsburg, Sauk County by Jon and Sharon Peterson in accordance with the PUD (clustering) provisions of Sections 7.05B(2)(c), 7.12 and 22.71 of the Sauk County Code of Ordinances.
Mr. Gurney gave the staff report and Findings of Fact for Jon and Sharon
Peterson. Discussion followed. Conditional use permit standards were discussed.
Conditions were reviewed with no additions. The easement location was discussed.
Motion by Sprecher, seconded by Gaalswyck to approve the Conditional Use
Permit and Preservation Area Easement.
Motion carried, 5-0.
The next item was discussion and action on the application for a conditional use permit to create a 3.00 acre residential lot in Section 20, T10N, R4E, Town of Reedsburg, Sauk County by Howard and Dana Engel in accordance with the PUD (clustering) provisions of Sections 7.05B(2)(c), 7.12 and 22.71 of the Sauk County Code of Ordinances.
Mr. Gurney gave the staff report and Findings of Fact for Howard and Dana
Engel. Conditional use permit standards were discussed. Conditions were
reviewed. No additional conditions were added. Motion by Gaalswyck, seconded
by Sprecher to approve the Conditional Use Permit and Preservation Area
Easement.
Motion carried, 5-0.
Discussion and action followed on the application for a conditional use permit to create a 2.26 acre residential lot in Section 24, T10N, R3E, Town of Franklin, Sauk County by David P. Smith in accordance with the PUD (clustering) provisions of Sections 7.05B(2)(c), 7.12 and 22.71 of the Sauk County Code of Ordinances.
Mr. Gurney gave the staff report and findings of fact for David Smith.
Conditional use permit standards were discussed. Motion by Sprecher, seconded
by Ashford to add the following statement to the Findings of Fact section, "The
proposed easement area is productive from an agricultural standpoint as
it contains lands that are actively cultivated and grazed."
Motion carried, 5-0.
Motion by Gaalswyck, seconded by Weise to approve the Conditional Use
Permit and Preservation Area Easement.
Motion carried, 5-0.
Discussion and action followed on the application for a conditional use permit to create a 3.92 acre residential lot in Section 15, T11N, R4E, Town of Westfield, Sauk County by Robert and Harold Gavin in accordance with the farm consolidation provisions contained in Section 7.05B(2)(c) of the Sauk County Code of Ordinances.
Mr. Gurney gave the staff report and Findings of Fact for Robert Gavin.
The same standards do not apply to this request. This meets the definition
of a farm consolidation in county ordinances and state statutes. Possibly
using a different form was discussed. Motion by Gaalswyck, seconded by
Ashford to approve the Conditional Use Permit.
Motion carried, 5-0.
Mr. Dave Tremble, Land Preservation Specialist, appeared to discuss the purchase of development rights from David and Debra Lundgren. This item was referred back to the Committee by the County Board due to an access issue. Discussion followed.
The Committee agreed an access easement was needed in order to take it back to the County Board. Discussion followed on the other two possible purchases adjoining the Lundgren property. It was suggested that all three purchases be brought in at the same time.
Discussion followed on the Board of Adjustment. Use and area variances as well as hardships were discussed. It was requested that the Board of Adjustment deliberate and submit a written request to the Committee for procedures on clarification of zoning qualifications.
