Committee Members Present: Gaalswyk, Sprecher, Ashford, Lehman, and Weise.

Others Present: Lance Gurney, Brian Simmert, Mary White, Lowell Haugen, Brent Bailey, Pat Dederich, Steve Pate, Brian Cunningham and others.

Chairman Weise called the meeting to order at 9:00 a.m., with Lehman absent, and compliance with the open meetings law was noted.

Motion by Ashford, seconded by Sprecher to adopt the agenda with moving items 9b and 9c up after item 6.
Motion carried 4-0.

Motion by Sprecher, seconded by Ashford to approve the minutes from the August 8, 2006, with a notation regarding a typographical error in the name "Richland" on the second page.
Motion carried 4-0.

Communications

Mr. Gurney reported that the Village of Rock Springs had passed a non-binding resolution to work with Mr. Kozlowski regarding annexation of land to the village to be used by his large cat refuge. This would remove the refuge from County jurisdiction.

Mr. Steve Pate, MIS, distributed copies of the Mapping Budget and the Land Records Modernization Budget.

The first item for discussion and action was an application for a conditional use permit to create two 3 acre residential lots in Section 34, T9N, R5E, Town of Troy, Sauk County by Jerry and Nancy Kaufman in accordance with the PUD (clustering) provisions of Sections 7.05B(2)(c), 7.12 and 22.71 of the Sauk County Code of Ordinances. Mr. Gurney gave the staff report and background information. The conditional use permit standards questions were read and answered. Committee member Lehman joined the Committee at this time. Findings of Fact and Conditions of the Conditional Use Permit were reviewed. Motion by Gaalswyck, seconded by Lehman to approve the easement and conditional use as requested by Jerald and Nancy Kaufman.
Motion carried, 5-0.

The next item was discussion and action on a conditional use permit to create three 2.5-3 acre residential lots in Sections 21 & 22, T10N, R6E, Town of Sumpter, Sauk County by Dave and Ruth Lohr in accordance with the PUD (clustering) provisions of Sections 7.05B(2)(c), 7.12 and 22.71 of the Sauk County Code of Ordinances. Mr. Gurney gave the staff report and background information. The conditional use permit standards questions were read and answered by the Committee. Findings of Fact and Conditions were reviewed. Motion by Gaalswyck, seconded by Ashford to approve the easement and conditional use permit as requested by David and Ruth Lohr.

The public hearing was called to order by Chairman Weise and the Committee members introduced at 9:30 A.M. The Chair reviewed the hearing order and procedures.

The first petition to be heard was Petition # 14-2006 to consider a revision to the Sauk County Agricultural Preservation Plan (Feb. 2006) to reflect amendments made to Chapter 7 Sauk County Zoning Ordinance and Chapter 22 Sauk County Land Division & Subdivision Regulations Ordinance related to Planned Unit Developments (cluster and conservation developments). To also make eligible the Town of Westfield to utilize Sauk County's Planned Unit Development Program and related agricultural preservation/zoning map.

Mr. Brian Simmert, Planning and Zoning Department Planner, appeared, gave a history of the amendment and briefly reviewed the changes. No action was being requested at this hearing.

The Town of Westfield Ag. Preservation Map was reviewed.

Mr. Tom Broughton, Town of Westfield Chairman, appeared in favor. He stated the Town of Westfield was in favor of the ordinance with no opposition.

Mr. Phil Craker, Town of Winfield Chairman, appeared as interest may appear. He did not want the restrictions to get too stiff and felt the towns could take care of themselves.

Seeing no one else wished to speak, the public portion of the hearing was closed at 10:00 A.M.

No action was taken in light of the fact that the revisions are scheduled to be acted on by the Wisconsin Land and Water Conservation Board in October. They will then come back to the Committee for action and the County Board for adoption.

The next petition to be heard was Petition #18-2006 for approval of a rezone out of a Wetland (Shoreland-Wetland per Ordinance Section 8.10) zoning district for the purpose of constructing a street and bridge for a proposed subdivision in the Town of Reedsburg. The property is currently owned by Copper Creek Crossing, LLC and John & Judith Hasheider although the application is being made by the Town of Reedsburg as the potential owner of the right-of-way. The parcel of land affected by the rezone is located in Section 1, T12N, R4E in the Town of Reedsburg, Sauk County, Wisconsin.

Mr. Brian Simmert, Planner, gave the staff report. He explained that this was actually a rezone out of Chapter 8. Staff recommendation was to table a decision until the H&H study and survey to define the exact boundaries of the wetland areas could be completed.

Mr. Lance Gurney, Planning and Zoning Director, appeared. He provide an explanation of the process for this proposal. Wetlands mitigation and floodplain are two issues involved. Placement of fill was discussed. Town roads are involved, therefore, the Town of Reedsburg is the applicant.

Ed Brooks, Town of Reedsburg Chair, appeared in favor. He stated that two structures are already in place and will be improved. The Town supports the development of this area and it was designated so in their town plan.

Mr. Brad Palubicki, representing Copper Creek Crossing, LLC, registered in favor.

Mr. Jamie Brandt representing Team Engineering appeared in favor. He stated on-site mitigation could be done to increase the boundary between Copper Creek and the development. The two existing structures will need to be brought up to town standards. The Department of Natural Resources may take another month before making any decisions. Groundwater was discussed, as well as shared wells and septic systems. Size of lots was also discussed.

Mr. Jason Kodow, representing Copper Creek Crossing, LLC, registered in favor.

Mr. Phil Cracker, Town of Winfield Chair, stated the town has no problem with the project.

Chairman Weise closed the public portion of the hearing at 10:45 A.M..

Motion by Ashford, seconded by Gaalswyck to table this item until the Committee has information from the H&H study and wetlands mitigation was completed.

The Committee reconvened into regular session.

Mr. Brian Cunningham, Zoning and Environmental Specialist with the Planning and Zoning Department, then appeared to discuss permitting and oversight of spreading of septic system effluent in Sauk County. NR113 requirements were discussed. Added staff would not be needed to take over this program. Motion by Sprecher, seconded by Ashford to find out more about this program and bring it back to the Committee for their consideration.
Motion carried, 5-0.

Mr. Brent Bailey, Register of Deeds, appeared and did not have a monthly report. He distributed his department's budget and brief discussion followed. Motion by Ashford, seconded by Lehman to approve the Register of Deed's budget.
Motion carried, 5-0.

He distributed his voucher list. Motion by Lehman, seconded by Gaalswyck to approve the vouchers in the amount of $1,291.22.
Motion carried, 5-0.

Mr. Pat Dederich, County Surveyor, appeared and distributed his proposed budget. Health insurance was discussed. Motion by Ashford, seconded by Sprecher to approve the Surveyor's proposed 2007 budget.
Motion carried, 5-0.

Mr. Lance Gurney distributed his budget along with supporting budget information. Revenue shortages were discussed. Discussion followed on maintenance program and fees. Mr. Gurney will have the budget ready for approval at the next meeting.

The Committee reviewed the Planning and Zoning Department vouchers. Motion by Lehman, seconded by Gaalswyck to approve the vouchers in the amount of $1,569.56.
