Committee Members Present: Ashford, Gaalswyk, Lehman, Cassity, and Netzinger.

Others Present: Mark Steward, Mary White, Pat Dederich, Brian Simmert, Larry Volz, Lowell Haugen

Chairman Cassity called the meeting to order and staff certified compliance with the open meeting law.

Motion by Ashford, seconded by Gaalswyk to adopt the agenda. Rearranging the agenda order for the public was briefly discussed. Motion carried, 4-0.

Motion by Ashford, seconded by Netzinger to approve the minutes of the January 14, 2009 meeting. Paragraph "Communications" was discussed with no changes. Motion carried, 4-0.

Lehman joined the Committee at this time.

Public Comment: None

Communications: Steward discussed an e-mail he received stating the jurisdictional transfer of Highway 12 has been completed. There was a question as to who is responsible for replacing fire signs along Highway 12 within the transfer area. Fire numbers would not change but the signs would have to be replaced because of name change of the road. Steward reported he had staff working on exactly which signs would need to be replaced.

Pat Dederich, County Surveyor, appeared with his vouchers. Motion by Gaalswyk, seconded by Ashford to approve the vouchers in the amount of $10,200.00. The Committee found that payment was appropriate. Motion carried, 5-0.

The Committee then reviewed the vouchers for the Planning and Zoning Department. Motion by Gaalswyk, seconded by Lehman to approve the vouchers in the amount of $778.76. Motion carried, 5-0.

The Planning and Zoning Department's 2008 budget was reviewed. After final accounting changes are made the Department should be in the black. The Wisconsin Fund monies were discussed and how the Department was handling notifying people about the program.

The Board of Adjustment budget was briefly reviewed.

Quarry operations, specifically the Rock Springs quarry, and Board of Adjustment decisions were discussed.

A Committee budget report was reviewed. This showed 2006 - 2007 year end figures, along with 2008 - 2009 to date.

Brian Simmert, Planner, appeared regarding a rezoning request in the Town of Delton by David and Inger Clemens. He explained that the County did not need to have a public hearing on this request, but County Board approval was necessary. He gave a brief background on rezoning request. Larry Volz, Town of Delton, reported that there was no opposition by the town. Motion by Lehman, seconded by Ashford to approve the request. Motion carried, 5-0.

The next item for discussion was a conditional use permit for a farm consolidation for Frieda Brei in the Town of Franklin. Simmert gave a short background report. Motion by Gaalswyk, seconded by Lehman to approve the request. The conditional use permit standard was read and answered affirmative. The wording "An act combining two or more farms to create a smaller number of farms" was discussed. The Land and Water Conservation Board would need to be contacted to change the wording. The State requires that particular language. There was further discussion regarding a mobile home on the property. The Committee requested removal of this mobile home to be added to the conditions of approval. Gaalswyk motioned, seconded by Lehman to amend the motion to include removal of the mobile home. Motion called to approve the request, carried, 5-0. A vote was called on the amended motion, carried, 4-1 with Netzinger in opposition. Discussion on PUDs instead of farm consolidations followed. It was suggested that a PUD should be required when not combining two farms.

Steward gave a brief report on the steel septic tank inventory on Lake Redstone. He reported 170 systems were checked, 30 completely passed, 52 permits for replacement systems were issued and 7 citations issued.

Items for next agenda: livestock siting ordinance, and a public hearing at 10:30 A.M., on amendments to Chapters 22 and 7 of the Sauk County Codes.

Motion by Ashford, seconded by Lehman to adjourn.
