The Sauk County Board of Adjustment hears requests for special exception permits, variances and administrative appeals from the Sauk County ordinances.

About the Board of Adjustment

In order to file for a hearing before the Board of Adjustment the "Notice of Appeal" application form must be filled out. Depending on what you are applying for, be sure to select the proper application. Notice of Appeal - Special Exception Permits (see below), Notice of Appeal - Variance (see below), and Notice of Appeal - Administrative Decision Challenge (see below). You must also submit a Town Acknowledgment form (see below) as part of your application. All applicants must fill out the general information indicating type of appeal and the legal description of the property, which can be obtained from the tax bill, plat book or other documents.

The applicant must then complete the sections relative to his/her appeal and the form must be signed and dated. The Board of Adjustment hearing is usually held on the fourth Thursday of each month. Applicants are notified of the specific time and place by mail. A $500.00 fee is required for each application. Checks covering this fee should be made payable to the Sauk County Board of Adjustment and is non-refundable. The application form, fee, letter of explanation and a plot plan must be postmarked or handed into the Land Resources & Environment Department approximately (6) six weeks prior to the hearing date. One copy of all exhibits are required.

An applicant is legally responsible for providing all information necessary to justify the action being requested. The Board of Adjustment must deny an appeal if insufficient information is available to it at the hearing. While the Land Resources & Environment Department will try to help make sure relevant information has been provided at the time of application, the applicant or an agent with full knowledge of the appeal should be personally available at the hearing to answer questions which may arise. If the applicant for a permit to conduct any activity on land is not the landowner, proof of the owner's consent to the application shall be required at the hearing.
