APPEALS:
Petition 09-2021. To hear and decide an appeal pursuant to s.7.149(2)(a) of the Sauk County
Zoning Ordinance where it is alleged that there is an error in any interpretation, order, requirement,
decision, or determination my by the zoning administrator or any administrative official in the
enforcement, administration, or interpretation of this chapter or of Wis. Stat. § 59.69. This appeal
pertains to the interpretation of Sauk County Code s.7.19(5)(a). The appeal is associated with
land described as part of the SW ¼ of the NW ¼ of Section 05, Township 09 North, Range 06
East, including tax parcel 028-0116-00000, Town of Prairie du Sac, Sauk County, WI.
Templin appeared and requested that the item be postponed to the July 29, 2021 BOA
meeting. Mr. Walker Smith representing Mr. Urban was present and had no comment.
Motion by White, second by Peper to postpone the hearing for petition 09-2021 to July 29, 2021.
Motion carried, 5-0
Petition 10-2021. A petition to consider variance request to s. 7.098(2) of the Sauk Count Zoning
Ordinance, for approval of locating a structure 28 ft. from the road right of way of County Road
F. The request is associated with land described as part of the SW ¼ of the NW ¼ of Section 22,
Township 13 North, Range 4 East, including tax parcel 042-0462-00000, Town of Winfield, Sauk
County, WI.
Templin appeared and provided the staff report and analysis of the request.
Mike Barreau, applicant, provided his statement.
White stated that the Townships are getting stricter with the right ways. Phephles asked how many
feet from the building to the snowmobile trail. Barreau stated it was 25-30 feet away. Phephles
asked how close the working farm area is to the trail. Barreau said it was across the road.
White reminded Barreau about the statutory variance criteria. Barreau stated the hardship would
be that farmland would be put out of production if the building would have to be moved.
Barreau stated that the unique physical property limitations would be because of the slope and the
removal of trees and rerouting the snowmobile trail if the building would have to be put on a new
location. Barreau felt it would not harm the public interest it would make it better.
White asked if there was anyone wish to speak. Chair White closed the public portion of the
hearing and the Board went into deliberation at 9:32 am.
Board members deliberated and determined that the variance did not meet the criteria as noted for
the record. Motion by Allen, second by Peper to deny the request for a variance. Motion Carried
5-0.
Next meeting date – Thursday, July 29, 2021
Adjournment:
Motion by Allen to adjourn, second by Phephles. Motion passed, 5-0. Meeting adjourned at 9:41 a.m.
