Due to the COVID-19 health emergency, this meeting will be conducted "In Person" and virtually or by phone. Attendance by supervisors appearing in-person will be limited to members of the Land Resources and Environment Committee. All other supervisors who wish to attend virtually or by phone must call or email the County Clerk for an access link. Chair White called the session of the Sauk County Board of Adjustment (BOA) to order at approximately 9:05 A.M. The Chair introduced the members of the Board, explained the procedures and the order of business for the day. The staff certified that the legally required notices were posted for the scheduled public hearing. The certification of notice was accepted on a motion by Allen, seconded by Mercier. Motion carried, 5-0.
The Board adopted the agenda for the August 27, 2020 session of the Board on a motion by Mercier seconded by Allen. Motion carried, 5-0.
The Board adopted the minutes from the May 28, 2020 Board of Adjustment meeting on a motion by White, seconded by Peper. Motion carried 5-0.
COMMUNICATIONS:
None.
ELECTION OF VICE CHAIR:
Chair White had the board introduce themselves. Nomination by Allen/White to nominate Peper as Vice Chair. Motion carried 5-0.
RECOMMENDATION OF TRI-COUNTY AIRPORT COMMISSION MEMBERS:
Wilson explained the Airport Commission membership. White volunteered to remain on the commission, Peper will represent the county board, and Phephles.
APPEALS:
A. A. SP-07-2020 Granting of a special exception permit pursuant to s. 7.032(3)(g) to authorize the construction of a pond within the required setbacks. This property is located in an Exclusive Agricultural zoning district, on real estate described as: S8622 Denzer Rd, part of the E ½ , NW ¼, Section 22, T10N, R5E, Town of Honey Creek, tax parcel 020-0810-02000.
Gina Templin-Steward, Land Resources and Environment, appeared and provided a background and history of the request, the photos of the site and the approval from the Town of Honey Creek. She concluded with the recommended conditions should the special exception permit be approved by the Board.
Laura Nagel, applicant, appearing in favor of the request, provided a letter from the neighbor.
White asked about how the pond came about. Nagel explained the desire for a recreational pond.
White asked about the contractor and obtaining a permit. Nagel stated they hired the Bruce Company and they were in charge of permits.
White asked how deep the pond will be. Nagel stated the max depth will be 10 feet.
White asked how it will be filled. Nagel stated with hose water and rain water. White asked if there will be fish in it. Nagel stated there will be. White stated she should watch for oxygen levels.
Mercier asked if this letter is from the person who notified the county. Nagel stated the letter is from the neighbor who is adjacent to the pond.
Peper asked how long ago the pond was started. Nagel stated it was started the first week of June.
Peper asked if the Town Board was involved in making any decisions. Nagel explained.
Seeing as no one else wishes to speak, Chair White closed the public portion of this hearing at approximately 9:24 a.m.
White stated it is unfortunate the contractor didn’t get permits. She also explained the conditions listed by staff.
Allen felt the request met all the requirements.
Mercier stated he had no issues with the request and felt it met all the requirements.
Peper asked about a DNR requirement.
Phelphes noted no concerns.
Motion by White, seconded by Mercier, to approve the special exception permit for a pond, upon findings of fact, conclusion of law and subject to staff analysis with recommended conditions by the Land Resources and Environment Department. Motion carried 5-0.
Motion by Allen, seconded by Phephles, to adjourn at 9:27 a.m. Motion carried, 5-0.
