This meeting is open to the public. In light of the COVID-19 pandemic, however, members of the public may wish to watch the meeting on streaming video which can be found on the Sauk County webpage at https://www.co.sauk.wi.us/meetings. No one should attend the meeting if they are experiencing COVID- or flu-like symptoms, have a fever, sore throat or recently experienced a loss of taste or smell. Masks are encouraged but not required. Social distancing of 6 feet is required.

7. Public Hearing: To begin at approximately 9:15 a.m. or soon thereafter. Committee to consider and take possible action at the conclusion of the respective hearing.
a. Petition 15-2022. A petition to consider a conditional use permit pursuant to s7.027(3)(g) for Agriculture tourism. Lands affected by the proposed conditional use are located in Section 26, T12N, R5E, Town of Excelsior, tax parcel identification number 010-0985-00000, and owned by Ron and Maureen Bula.
b. Petition 17-2022. Ordinance Amendment. A request to consider approving a amendment to the Sauk County Chapter 7 Zoning Ordinance to include amendments to sections 7.011(13), 7.035 and 7.077. The proposed amendment has the effect of altering the definition of animal sanctuary, the zoning district in which the use is allowed and the required secondary standards. This would affect all Towns within the unincorporated lands of Sauk County within the agricultural, resource conservancy, and rural community zoning districts. The ability to enact the proposed ordinance amendment is granted pursuant to Wis. Stats. § 59.69(5)(e).
8. Discussion and possible approval of a Development Plan and Final Plat for Phase 2 Foster’s Shore Estates subdivision. Said subdivision is described as being part of the NW ¼ of the NW ¼ of the SW ¼, the NE ¼ of the SW 1/4, the SE ¼ of the SW ¼ and the SW ¼ of the SW 1/4, Section 4, T.10N., R.7E., Town of Merrimac, Sauk County, Wisconsin containing 29.73 acres more or less.
9. Discussion and possible action on notices of noncompliance for the Farmland Preservation Program
10. Discussion/Presentation on the parks service area programs.

At 9:05 a.m. Krueger called the Land Resources and Environment Committee meeting to order and certified the meeting to be in compliance with the Open Meetings Law.
Adopt agenda: Motion by Lohr/Eberl to adopt the agenda moving Public Comment before item 9 on the agenda. Motion carried, all in favor.
Adopt minutes of previous meetings – June 9, 2022 and June 24, 2022: Motion by McAuliffe/Kinsman to approve the June 9, 2022 and June 24, 2022 LRE Committee meeting minutes. Motion carried, all in favor.
Communications: Wilson reminded everyone of the Powers Pasture Walk on July 14, 2022.
Review and approval of vouchers –Wilson presented the LRE vouchers in the amount of $29,838.59. Motion by Kinsman/McAuliffe to approve vouchers in the amount $29,838.59. Motion carried, all in favor

Hillmann appeared and presented the background and history. Hillmann provided 3 letters, 1 in opposition and 2 in favor.

Chair Krueger closed the public hearing portion and went into deliberation at 9:45 a.m.
Motion by Kinsman/Lohr to approve a conditional use permit for Agriculture tourism based on the findings of fact and conclusion of law, subject to the staff analysis and recommended conditions in the staff report. Motion unanimously approved.

Templin-Steward appeared and provided a request from Larry and Melanie Barton. Barton inquired to see what kind of permits are required to establish an animal rescue facility that serves aging and special needs dogs, as well as assisting with fosters and adoptions on property in the Town of Greenfield. Eberl asked is there are any other sanctuaries in the County. Templin-Steward state there is one in the Town of Winfield where there are lemurs. Polivka asked under the new language you would be allowed to adopt. Templin-Steward stated that is correct. Eberl asked if the setback is being reduced to 200 feet from 500 feet. Templin-Steward explained. Eberl asked if this would apply to other animals. Templin-Steward stated it would be for domestic animals. McAuliffe asked if there is a requirement for the owner to live on site. Templin-Steward explained.
Larry Barton appeared in favor of the Ordinance Amendment.

Fowler presented background and history of the request. Eberl asked what the Department of Administration looks at in a project like this. Wilson explained. Motion by Polivka/Spencer to approve the Development Plan and Final Plat for Phase 2 Foster’s Shore Estates Subdivision located in the Town of Merrimac containing 29.73 more or less with the recommended two conditions in the staff report plus the two conditions that were added regarding the Indian burial sites at Effigy Mounds and financial assurance by the developer. Motion passed unanimously.
Public Comment:
Gary Johnson, Gary Moseman, Thomas Ederer, Sam Liegel, Greg Wilkinson, Joe Prem, and Tonya Schneider came forward asking to be reinstated in the Farmland Preservation Program after turning in their Nutrient Management Plan after deadline.
Discussion and possible action on notices of noncompliance for the Farmland Preservation Program.
Schlupp provided background information on the Farmland Preservation Program and nutrient management plan submission deadline of June 1, 2022. Polivka asked if there were still some people that Schlupp has not received plans from. Schlupp stated there are eight plans that have not been submitted. Eberl asked if any of the landowners that submitted late plans were out of compliance. Schlupp explained. Puttkamer asked if there would be a consideration to move nutrient management plan submission deadline to coincide with the Farm Service Agency crop reporting deadline.
Schlupp explained. Polivka asked if there was a change in field conditions, and they would plant something other than what the plan stated, would they be penalized for that. Schlupp explained. Motion by Polivka/Puttkamer to reinstate the participants that turned in their Nutrient Management Plans to the department after the deadline and the eight landowners the department has not heard back from will receive notices of noncompliance. Krueger asked Schlupp to confirm who will receive the notices of noncompliance; Dan Hahn, Lawrence Wilkinson, James Neider, Pat McGlynn, Ruth Oetzman, Ruth Oetzman Living Trust, Michael Reuter, and Brad & Kim Shyvinck Trust. Motion passed unanimously.
