Purpose

Amendment Section 20.07, Chapter 20, Uniform Citation Ordinance

Background

BACKGROUND:

With the repeal and replacement of Chapter 10 County Parks, updates to Chapter 20 to allow enforcement and compliance of the chapter are also necessary.

WHEREAS, pursuant to 66.0113(1)(c), the County is authorized to set a schedule of forfeitures for violations of County Ordinances; and,

WHEREAS, amendments to Chapter 10 County Parks have resulted in the need for code section numbers in Chapter 20 Uniform Citation Ordinance to be updated; and,

WHEREAS, the Land Resources and Environment Committee reviewed the item at their regularly scheduled meeting on April 14, 2022 and recommended approval of the ordinance amendments as presented; and,

Fiscal Note:  The forfeiture amount listed is what is provided to the department through the court system.  The 2022 LRE Budget includes $10,500 in court ordered and construction fines.

NOW, THEREFORE, THE SAUK COUNTY BOARD OF SUPERVISORS DOES ORDAIN AS FOLLOWS:

Section 1.  Any existing ordinances, codes, resolutions, or portions thereof in conflict with this ordinance shall be and hereby are repealed as far as any conflict exists.

Section 2.  This ordinance shall take effect the day after passage and publication as required by law.

Section 3.  If any claims, provisions or portions of this ordinance are adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance shall not be affected thereby.

            Section 4. Chapter 20 of the General Code of Sauk County, Wisconsin, is amended as follows [additions noted by underline, deletions noted by strikethrough]:

            1. Section 20.07(6) of the County Code of Ordinances is amended to read:

Chapter 10: County Parks pursuant to Section 10.05(1) 10.16 which authorizes penalties of not less than $10.00 nor more than $100.00.
