Purpose

Ordinance Amendment to ordinance sections 10.05 and 10.15 of the Sauk County Ordinances related to the creation of the Historic Courthouse Park

Background

The Sauk County Board of Supervisors has created the “Historic Courthouse Park.  Chapter 10 of the County ordinances regulates parks in Sauk County. It is the intent of the Property Committee and the Land Resources and Environment Committee that the “Historic Courthouse Park” be managed by the Building Services Department and not the Land Resources and Environment Department as currently set forth in the ordinances.

Resolution Body

Section 1.  Any existing ordinances, codes, resolutions, or portions thereof in conflict with this ordinance shall be and hereby are repealed as far as any conflict exists.

Section 2.  This ordinance shall take effect the day after passage and publication as required by law.

Section 3.  If any claims, provisions or portions of this ordinance are adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance shall not be affected thereby.

            Section 4. Section 10.05 and 10.15 of the General Code of Sauk County, Wisconsin, is amended as follows [additions noted by underline, deletions noted by strikethrough]:

 

Sec. 10.05. - Special events.

Planned or advertised public meetings or assemblies, sporting and athletic events or other special events, are allowed in parks only by written permit issued by the Director or the Director's designee. A special event application and policy can be obtained through the Land Resources and Environment Department. See Section 10.15(c) below regarding permits for the use of the Historic Courthouse Park.

 

Sec. 10.15. - Other permits.

            (a)        All permits shall be issued by the Committee, Director, or their designee, in writing, except camping permits, shelter permits or building use permits issued by the Director or their designee, and subject to the park rules and regulations, and the persons to whom such permits have been granted shall be bound by said rules and regulations as fully as though the same were inserted in said permits, and any person or persons to whom such permits have been granted shall be liable for any loss, damage, or injury sustained by the Committee. Department or by negligence of the person or person to whom such permits have been granted, their servants or agents.

            (b)        Until otherwise directed by the Sauk County Board of Supervisors, the Sauk County Land Resources and Environment Committee is hereby authorized to adopt additional or revised rules and regulations for the

                        proper conduct and administration of the parks and parkways in the County of Sauk not inconsistent with this chapter, to grant permits in conformity with the provisions hereof, and to perform such other acts with reference to the management of said parks expedient to promote the beauty and usefulness of said parks, parkways, and trails and to increase the comfort, safety, convenience and public welfare of the citizens of Sauk County and of visitors to said parks and parkways in their use of the same.

 

            (c)        All permits for the use of the Historic Courthouse Park shall be issued by the Sauk County Building Services Department and be subject to the rules and regulations for said park as authorized by the oversight committee of the Building Services Department.
