7. Public hearing: To begin at approximately 9:15 a.m. (Committee to consider and take possible action at the conclusion of the respective hearing.)
a. Petition 14-2017. A petition to consider a rezone from an Exclusive Agriculture to an Agriculture zoning district pursuant to s. 7.150 Ordinance Amendments of the Sauk County Zoning Ordinance. Said rezone is located in the Town of Honey Creek, Sauk County, Wisconsin. Lands to be affected by the proposed rezoning are located in part of the Southwest One-Quarter of the Southeast One-Quarter and in part of the Southeast One-Quarter of the Southwest One-Quarter, all in Section 14, Township 10 North, Range 5 East, Town of Honey Creek, Sauk County.
b. Petition 15-2017. A petition to consider a conditional use permit pursuant to s7.040(4)(d) a mini-warehousing business. Said conditional use is located in the Town of Baraboo, Sauk County. Lands affected by the proposed conditional use are located in the NE ¼ of the SE ¼, Section 3, T11N, R6E, Town of Baraboo, and as further described in Petition 15-2017. Tax parcel identification number 002-0082-00000.
8. Discussion and possible action on the “Wisconsin Shoreland Initiative”.
9. Discussion and possible action on a Conditional Use Permit for Planned Rural Development (PRD) of a lot for Nathan Litscher located in Sections 5/6, T9N, R6E, Town of Prairie du Sac, Sauk County, pursuant to Subchapter IX, of the Sauk County Zoning Code of Ordinance.
10. Discussion and possible action on Conservation, Planning and Zoning Department Fee Schedule.
11. Next meeting dates - Thursday, July 13th and Tuesday, July 25th, 2017.

Conservation, Planning, and Zoning (CPZ) Committee members present: D. Polivka, E. Peterson, C. Spencer, J Ashford, J. Dietz, M. Flint, C. Pettersen, S. Laubscher.
Absent: None.
Others present: L. Wilson, B. Simmert, G. Templin, S. Sorenson, T. Liebman, M. Krueger, A. Bolin. See registration slips for those in attendance for public hearing.
At 9:00 a.m. Polivka called the Conservation, Planning, and Zoning Committee meeting to order and Templin certified to be in compliance with the Open Meetings Law.
Adopt agenda: Motion by M. Flint/C. Pettersen to adopt the agenda as presented. Motion carried, all in favor.
Motion by S. Laubscher/C. Spencer to approve the June 13th CPZ Committee meeting minutes. Motion carried, all in favor.
Public Comment:
None.
Communications:
None.
Discussion and possible action pertaining to the County Surveyor Wilson provided an update on a meeting held with the County Surveyor, herself, Administrative Coordinator and Corporation Counsel. Wilson stated the approval authority was discussed and emphasized, which is CPZ. Wilson stated that the surveyor will keep his comments limited to Chapter 236 State Stats and Chapter 22 Sauk County Code of Ordinances. Wilson explained that everyone seems to be on the same page and there is a follow up meeting scheduled for the end of July to check on status.
Liebman appeared and provided the committee with information on options the County has in regards to the services provided by the County Surveyor. The Committee requested Liebman to follow up with more information after July, if necessary.
Bolin appeared and spoke about the meeting that took place and explained that some process issues were identified and corrective actions discussed. Bolin stated that the scope of duties were explained.

Sorenson appeared and provided the background and history of the property and petitioner’s request as well as verified that the Town of Honey Creek has approved of the proposed rezone of the property.
Flint explained that the Town didn’t approve in the material provided. Sorenson stated he received an email from the Town, which he didn’t provide in the packet of information.
Spencer asked if Sorenson found the material offsite as part of an inspection or part of a complaint. Sorenson stated it was part of an inspection.
Tim Goeghegan, Yahara Materials, appearing in favor of the request, explained they had materials stored in an area that is not part of the originally approved quarry and need the rezone in order to expand the quarry.
Seeing as no one else wished to appear, Chair Polivka closed the public portion of the hearing at 9:25 a.m., and the committee deliberated.
Motion by C. Spencer/E. Peterson to approve the rezoning from Exclusive Agriculture to Agriculture for the purpose of obtaining a Special Exception Permit for the expansion and operation of a non-metallic mining site. Motion carried, all in favor.
b. Petition 15-2017. A petition to consider a conditional use permit pursuant to s7.040(4)(d) a mini-warehousing business. Said conditional use is located in the Town of Baraboo, Sauk County. Lands affected by the proposed conditional use are located in the NE ¼ of the SE ¼, Section 3, T11N, R6E, Town of Baraboo, and as further described in Petition 15-2017. Tax parcel identification number 002-0082-00000.
Wilson appeared and provided the background and history of the property and petitioner’s request. She confirmed the Department received documentation from the Township recommending approval as well as reviewing conditions requested be placed on the CUP.
Ashford asked if this is the same site that was considered a couple years ago. Polivka stated it is.
Norbert Moy, applicant, appearing in favor of the request, stated they currently have 7 buildings with 490 units with 460 units filled, which is why the need for the addition to the complex.
Peterson asked if there is someone on site. Moy stated their offices are located at Moy/Borchert Accounting.
Peterson asked if all transactions are done there. Moy stated they are done online and they never have to see anyone.
Peterson asked about the security gate. Moy stated there is code which is their birthday and the unit number.
Ashford asked if this is the last addition to the storage units. Moy stated this will be the last addition.
Flint asked about security system. Moy stated there are cameras which can be viewed via smart phones. Flint asked about security alarms for police. Moy stated he does not believe there are alarm systems.
Kory Anderson, General Engineering, appearing in favor of the request, stated he is the engineering consultant that prepared the plans for the applicant and will be preparing the permits requested by Conservation, Planning and Zoning.
Flint asked about the greater water storage area. Anderson explained stormwater requirements.
Randy Puttkamer, appearing in favor of the request, stated he is appearing for the Town of Baraboo, spoke of the Town stormwater requirements.
Tom Pinion, City of Baraboo, appearing in opposition, stated the original permit was approved as a Special Exception Permit and they are now requesting a Conditional Use. He stated he has issues with the applicant conforming to the original conditions as the building exceeds the amount of units originally allowed, stormwater issues, sidewalk issues with the DOT, police officers taking complaints on the property, sanitary facilities not approved, but a port-o-potty has been on site. He also spoke of the lack of vegetative buffer being implemented. He spoke of the requirement to manage the stormwater on site.
Peterson asked about jurisdiction. Pinion explained.
Norbert Moy, reappearing.
Flint asked why the Knox Box was not put up and complied with. Moy stated he is not sure why it was not put up and does not have a problem with putting one up.
Flint asked about the sidewalk maintenance and why it is not taken care of properly. Moy stated he has opposed the sidewalk, but they are now taking care of it.
Flint asked about the water retention and asked if there is compliance. Moy stated he feels they met all stormwater requirements and feels they went above all regulations.
Flint asked about the number of units and going past the allowed units. Moy stated in the first development there were 4 building and in phase 2 there were 3 additional buildings. Flint stated they went over their count. Moy stated it made more sense to go over the allowed count with the units that were selling, which was approved by the County.
Tom Pinion, reappearing, stated the city has concern about the onsite well and septic, and explained the protection of the city’s well water and the concern of a private well and the potential of contamination.
Peterson asked if the City could supply water and sewer. Pinion stated it is possible, but the City’s ordinance states you would have to annex, so it would have to change in order for them to connect right now. Peterson asked if there could be a waiver considered. Pinion stated a request to the City could be made, but he could not answer that.
Moy, reappearing.
Polivka asked why a private septic and well is being requested and if necessary. Moy stated they could be flexible on that, and the intent would be to have an office or meeting room and have a bathroom, allowing people to get out of the elements, and the intent was more of a convenience for the customers.
Peterson asked if there has been any discussion with the City about their services. Moy stated there has not been.
Peterson spoke of the City having issues with people possibly staying there and now with providing restrooms if that would increase people living in the storage units. Moy stated they did have a complaint about someone living there and they did take steps to evict the tenant.
Flint asked about the barrier on the west. Moy explained the Zoning Ordinance requires screening.
Seeing as no one else wished to appear, Chair Polivka closed the public portion of the hearing at 10:00 a.m., and the committee deliberated.
Peterson spoke of the need to take care of some of the City’s concerns. Wilson noted that some concerns were addressed through testimony and conditions. Wilson stated that she did not believe the County could place conditions associated with City rules/regulations.
Motion by M. Flint/C. Pettersen to approve the Conditional Use Permit to authorize the location of a mini warehouse and subject to all conditions request by Conservation, Planning and Zoning. Motion carried, all in favor.
Discussion and possible action the “Wisconsin Shoreland Initiative” Wilson spoke of the initiative. Krueger suggested getting the WCA Land Resources staff to explain the proposed bill at the July 13th meeting. Motion by D. Polivka to postpone issue until the next meeting and add to the July 13th agenda. Motion carried.
Discussion and possible action on a Conditional Use permit for a Planned Rural Development (PRD) of a lot for Nathan Litscher located in Sections 5/6,T9N, R6E, Town of Prairie du Sac, Sauk County, pursuant to Subchapter IX, of the Sauk County Code of Ordinance. Simmert provided an updated proposed plan and explained the requested PRD and Conditional Use Permit for Litscher. He explained all standards have been met and meets the criteria for a PRD/CUP. He confirmed that the Town of Prairie du Sac will meet to address the request at their upcoming Town Board meeting. Motion by E. Peterson/C. Spencer to approve the Conditional Use permit for a PRD lot, with the condition that the Town of Prairie du Sac approve the request at their upcoming meeting. Motion carried, all in favor.
Discussion and possible action on Conservation, Planning and Zoning Department Fee Schedule Templin explained the fee schedule and inspection fee as part of the new ordinance. Motion by E. Peterson/C. Spencer to approve the clean landfill inspection fee and add to the Conservation, Planning and Zoning fee schedule. Motion carried, all in favor.
Next meetings of the Conservation, Planning, and Zoning Committee will be held on Thursday, July 13th , 2017, at 9:00 a.m. and Tuesday, July 25th , 2017 at 9:00 a.m. Motion by J. Ashford/C. Spencer to adjourn at 10:56 a.m. Motion carried, all in favor.
